href=\"https://laohu8.com/S/TSLA\">特斯拉</a>真栽了。</p><p>美国佛罗里达州的陪审团裁定,特斯拉应为2019年一辆配备自动驾驶系统的Model S所致的致命车祸承担部分责任,并判令特斯拉向一名遇难女性的家属及一名伤者支付赔偿金。</p><p>总计2.425亿美元。</p><p>这是什么概念?相当于17亿人民币,已经不是多少辆Model 3的事儿了,这个数字相当于特斯拉半个季度白干。</p><p>这不仅是目前特斯拉遇到的赔偿金额最大的官司,同时也是特斯拉在有关辅助驾驶案件中的首次败诉。</p><p>对此,特斯拉当然是不服,表示还会继续提出上诉。</p><p>不过,复盘整个案件后,特斯拉虽然显得“无辜”,但更像是马斯克之前吹过的牛皮,如今像回旋镖一样打在了自己的脑瓜上。<strong>01 半个季度利润的赔偿</strong></p><p>不知道马斯克会不会后悔,和解方案昨天刚刚公布,本来6000万美元(约4.29亿人民币)就可以解决了。。</p><img src=\"https://fid-75186.picgzc.qpic.cn/20250827160017693v206ljk0yzcsuf9\"/><p>而此次的天价赔偿,分为两部分,特斯拉需要向死者的遗产继承方及其严重受伤的男友共赔付 1.29 亿美元(约9.2 亿元人民币)的补偿性损害赔偿金。</p><p>另外一部分,是外加 2 亿美元(约14.3 亿元人民币)的惩罚性损害赔偿金,这部分属于惩罚性质。</p><p>其实按照宣判的责任划分,特斯拉只需要承担三分之一的责任,肇事车主需要承担三分之二的主责,也就是说,特斯拉其实可能只需要承担1亿多美元的赔偿,但是因为肇事车主已和原告达成和解,无法被选中为惩罚对象,因此这2亿美元的惩罚性赔偿金全都算到了特斯拉头上。</p><p>不过,特斯拉也表示,根据一份审前协议,惩罚性赔偿金不得超过其自身承担的补偿性赔偿金的三倍,因此最终支付金额会远低于陪审团裁定的2.43亿美元,实际应为1.72亿美元。</p><p>但原告方可不这么认为,协议中约定的赔偿倍数计算基础是 “全部补偿性赔偿金”(而非仅特斯拉承担的部分),因此特斯拉必须按陪审团裁定的2.43亿美元全额支付。</p><p>而且,在今年 5 月,特斯拉本来有和原告和解的机会,只需要赔偿6000万美元,特斯拉却选择拒绝。</p><p>这笔钱就算是对于特斯拉,也不是个小数目,比特斯拉今年一季度<span>净利润</span>的一半还要多。</p><p>事件的起因,还要从2019年的那场事故说起。</p><p>2019年4月25日晚上 21:05 左右,特斯拉车主McGee驾驶着一台Autopilot正处于开启状态的Model S,在经过一个T字形路口时,车辆失控,车辆以近百公里时速(60英里/小时)冲出,撞向路边停靠的一辆雪佛兰 Tahoe。</p><img src=\"https://fid-75186.picgzc.qpic.cn/20250827160018488v206n0prnifvrbz\"/><p>但不幸的是,在这台SUV旁边正好有一对情侣,结果就是事故导致22岁的Naibel Benavides当场身亡,她的遗体在撞击点75英尺(23米)外被发现,撞击力道极为猛烈。她的男友Dillon Angulo虽然幸存,但遭受了多处骨折、创伤性脑损伤及严重的心理创伤。</p><p>事故发生后,遇难者家属和伤者随后对车主和特斯拉提起诉讼,关键就在于为什么要把特斯拉一块告上法庭。</p><p>因为受害者家属认为,特斯拉也对事故负有责任。</p><p>根据驾驶人George McGee的表述,他是在驾车途中手机掉落,出于对特斯拉辅助驾驶的信任,低头去捡时认为车辆能在探测到障碍物时自动刹车。但没想到,车辆会在那时候失控,以超过60英里(96公里)/小时的速度冲进十字路口,撞上停在路边的一辆汽车和站在车旁的两人。</p><p>其实不难看出,车主McGee主责没得跑,事实上判决也是如此,McGee要承担67%的责任。不过,在这起诉讼之前,McGee跟受害者以及受害者家属,已经事先达成了庭外和解。</p><img src=\"https://fid-75186.picgzc.qpic.cn/20250827160024806v2060rtgvs5iwhc\"/><p>而受害者家则指控特斯拉的自动驾驶系统(Autopilot)存在设计缺陷,在营销上存在误导性,特斯拉也就成了这起案件中的唯一被告。</p><p>这起案件的争议也恰恰在于,肇事车主和特斯拉在这起事故中的责任划定,车主McGee虽承认事发时正低头捡拾滑落的手机,但让他做出这种行为的原因是,出于对特斯拉系统的信任,坚持以为Autopilot“会在紧急时自动刹车”。</p><p>这也是原告律师核心的指控,特斯拉明知系统仅适用于封闭高速公路,却放任其在城市道路激活;马斯克公开宣称“Autopilot比人类更安全”的营销话术,更模糊了技术责任边界。</p><p>在庭审中,原告律师提供了大量证据,意在证明特斯拉的自动驾驶系统未能正确识别道路上的障碍物,且在紧急情况下未能采取有效的避让措施。</p><p>在事发前,开启Autopilot的涉案车辆已经闯了一次红绿灯,还误识别一个交通标识,显然并不在封闭高速路段,而辅助驾驶系统在不适用的路况下并没有退出,这意味着车辆存在技术缺陷。</p><img src=\"https://fid-75186.picgzc.qpic.cn/20250827160025509v206touybhd0gbx\"/><p>此外,在特斯拉2016年的宣传Autopilot的视频开头,驾驶员仅因为法规要求坐在驾驶位,全程没有操作汽车,特斯拉自己驾驶等一系列行为,导致了给公众一种车辆可以自己驾驶的错觉,这就意味着特斯拉在功能上存在夸大宣传,误导消费者。</p><p>值得一提的是,这段视频也是不久前被自家自动驾驶负责人亲自“打假”的宣传视频,其表示不仅是伪造的,而且马斯克还亲自参与了伪造。</p><p>经过长时间的对质和审理,最终陪审团认定肇事者和特斯拉都有责任,才给出了双方“各打50大板”的判决。<strong>02 马斯克仍然头很铁</strong></p><p>面对这样的判决,特斯拉的态度自然是“不服”,甚至马斯克在判决下达的当天就表示过,特斯拉将对佛州陪审团裁决提起上诉。</p><p>“今天的判决是错误的,只会阻碍汽车安全,危及特斯拉和整个行业开发和实施救生技术的努力。”该公司称,原告编造了一个故事“把责任归咎于汽车”,而“司机从第一天起就承认并接受了自己应负责任”。</p><p>特斯拉方面坚持认为,这起事故完全就是因为司机的原因,主要是基于几点细节。</p><p>司机当时在路上是属于超速行驶的状态,而且在低头捡手机时,司机的脚仍然踩在加速踏板上,特斯拉以“驾驶员脚踩油门的行为覆盖了系统指令”作为抗辩理由。</p><img src=\"https://fid-75186.picgzc.qpic.cn/20250827160026333v206w6w8ojl3wlj\"/><p>另外,就是司机完全没有尽到观察路况的责任,光顾着找手机,并没有看路,而且系统曾提示过,不推荐在那条路开启Autopilot,但司机还是选择开启辅助驾驶功能。</p><p>总之在特斯拉看来,这起事故与Autopilot无关,车主应该承担全部责任。</p><p>特斯拉律师在辩护中强调,McGee是唯一的事故责任人,而且他也承认了责任,他几十次开车路过那个路口,是他低头捡手机的行为造成了事故。在2019年的时候,没有任何安全系统可以阻止类似的事故发生。“原告律师在编造谎言,试图将责任推卸给车辆。”</p><p>虽说司机分心是主因,但 Autopilot 关键时刻 “掉链子”,没能及时刹车,也难辞其咎。</p><p>当然,这不是特斯拉第一次因为Autopilot或者FSD辅助驾驶系统的相关车祸被起诉,自2016年以来,特斯拉已经卷入二十多起类似车祸事件,被事故车主或者死者家属起诉,但特斯拉每一次都坚称这是车主没有及时接管车辆,与辅助驾驶系统没有关系。而且基本上这些诉讼均已在未开庭审理的情况下得到解决或被驳回。</p><p>但这次案件却是特斯拉第一次输掉相关诉讼,被认定需要对事故承担部分责任,这也是特斯拉坚持上诉的原因。</p><img 3的事儿了,这个数字相当于特斯拉半个季度白干。这不仅是目前特斯拉遇到的赔偿金额最大的官司,同时也是特斯拉在有关辅助驾驶案件中的首次败诉。对此,特斯拉当然是不服,表示还会继续提出上诉。不过,复盘整个案件后,特斯拉虽然显得“无辜”,但更像是马斯克之前吹过的牛皮,如今像回旋镖一样打在了自己的脑瓜上。01 半个季度利润的赔偿不知道马斯克会不会后悔,和解方案昨天刚刚公布,本来6000万美元(约4.29亿人民币)就可以解决了。。而此次的天价赔偿,分为两部分,特斯拉需要向死者的遗产继承方及其严重受伤的男友共赔付 1.29 亿美元(约9.2 亿元人民币)的补偿性损害赔偿金。另外一部分,是外加 2 亿美元(约14.3 亿元人民币)的惩罚性损害赔偿金,这部分属于惩罚性质。其实按照宣判的责任划分,特斯拉只需要承担三分之一的责任,肇事车主需要承担三分之二的主责,也就是说,特斯拉其实可能只需要承担1亿多美元的赔偿,但是因为肇事车主已和原告达成和解,无法被选中为惩罚对象,因此这2亿美元的惩罚性赔偿金全都算到了特斯拉头上。不过,特斯拉也表示,根据一份审前协议,惩罚性赔偿金不得超过其自身承担的补偿性赔偿金的三倍,因此最终支付金额会远低于陪审团裁定的2.43亿美元,实际应为1.72亿美元。但原告方可不这么认为,协议中约定的赔偿倍数计算基础是 “全部补偿性赔偿金”(而非仅特斯拉承担的部分),因此特斯拉必须按陪审团裁定的2.43亿美元全额支付。而且,在今年 5 月,特斯拉本来有和原告和解的机会,只需要赔偿6000万美元,特斯拉却选择拒绝。这笔钱就算是对于特斯拉,也不是个小数目,比特斯拉今年一季度净利润的一半还要多。事件的起因,还要从2019年的那场事故说起。2019年4月25日晚上 21:05 左右,特斯拉车主McGee驾驶着一台Autopilot正处于开启状态的Model S,在经过一个T字形路口时,车辆失控,车辆以近百公里时速(60英里/小时)冲出,撞向路边停靠的一辆雪佛兰 Tahoe。但不幸的是,在这台SUV旁边正好有一对情侣,结果就是事故导致22岁的Naibel Benavides当场身亡,她的遗体在撞击点75英尺(23米)外被发现,撞击力道极为猛烈。她的男友Dillon Angulo虽然幸存,但遭受了多处骨折、创伤性脑损伤及严重的心理创伤。事故发生后,遇难者家属和伤者随后对车主和特斯拉提起诉讼,关键就在于为什么要把特斯拉一块告上法庭。因为受害者家属认为,特斯拉也对事故负有责任。根据驾驶人George McGee的表述,他是在驾车途中手机掉落,出于对特斯拉辅助驾驶的信任,低头去捡时认为车辆能在探测到障碍物时自动刹车。但没想到,车辆会在那时候失控,以超过60英里(96公里)/小时的速度冲进十字路口,撞上停在路边的一辆汽车和站在车旁的两人。其实不难看出,车主McGee主责没得跑,事实上判决也是如此,McGee要承担67%的责任。不过,在这起诉讼之前,McGee跟受害者以及受害者家属,已经事先达成了庭外和解。而受害者家则指控特斯拉的自动驾驶系统(Autopilot)存在设计缺陷,在营销上存在误导性,特斯拉也就成了这起案件中的唯一被告。这起案件的争议也恰恰在于,肇事车主和特斯拉在这起事故中的责任划定,车主McGee虽承认事发时正低头捡拾滑落的手机,但让他做出这种行为的原因是,出于对特斯拉系统的信任,坚持以为Autopilot“会在紧急时自动刹车”。这也是原告律师核心的指控,特斯拉明知系统仅适用于封闭高速公路,却放任其在城市道路激活;马斯克公开宣称“Autopilot比人类更安全”的营销话术,更模糊了技术责任边界。在庭审中,原告律师提供了大量证据,意在证明特斯拉的自动驾驶系统未能正确识别道路上的障碍物,且在紧急情况下未能采取有效的避让措施。在事发前,开启Autopilot的涉案车辆已经闯了一次红绿灯,还误识别一个交通标识,显然并不在封闭高速路段,而辅助驾驶系统在不适用的路况下并没有退出,这意味着车辆存在技术缺陷。此外,在特斯拉2016年的宣传Autopilot的视频开头,驾驶员仅因为法规要求坐在驾驶位,全程没有操作汽车,特斯拉自己驾驶等一系列行为,导致了给公众一种车辆可以自己驾驶的错觉,这就意味着特斯拉在功能上存在夸大宣传,误导消费者。值得一提的是,这段视频也是不久前被自家自动驾驶负责人亲自“打假”的宣传视频,其表示不仅是伪造的,而且马斯克还亲自参与了伪造。经过长时间的对质和审理,最终陪审团认定肇事者和特斯拉都有责任,才给出了双方“各打50大板”的判决。02 马斯克仍然头很铁面对这样的判决,特斯拉的态度自然是“不服”,甚至马斯克在判决下达的当天就表示过,特斯拉将对佛州陪审团裁决提起上诉。“今天的判决是错误的,只会阻碍汽车安全,危及特斯拉和整个行业开发和实施救生技术的努力。”该公司称,原告编造了一个故事“把责任归咎于汽车”,而“司机从第一天起就承认并接受了自己应负责任”。特斯拉方面坚持认为,这起事故完全就是因为司机的原因,主要是基于几点细节。司机当时在路上是属于超速行驶的状态,而且在低头捡手机时,司机的脚仍然踩在加速踏板上,特斯拉以“驾驶员脚踩油门的行为覆盖了系统指令”作为抗辩理由。另外,就是司机完全没有尽到观察路况的责任,光顾着找手机,并没有看路,而且系统曾提示过,不推荐在那条路开启Autopilot,但司机还是选择开启辅助驾驶功能。总之在特斯拉看来,这起事故与Autopilot无关,车主应该承担全部责任。特斯拉律师在辩护中强调,McGee是唯一的事故责任人,而且他也承认了责任,他几十次开车路过那个路口,是他低头捡手机的行为造成了事故。在2019年的时候,没有任何安全系统可以阻止类似的事故发生。“原告律师在编造谎言,试图将责任推卸给车辆。”虽说司机分心是主因,但 Autopilot 关键时刻 “掉链子”,没能及时刹车,也难辞其咎。当然,这不是特斯拉第一次因为Autopilot或者FSD辅助驾驶系统的相关车祸被起诉,自2016年以来,特斯拉已经卷入二十多起类似车祸事件,被事故车主或者死者家属起诉,但特斯拉每一次都坚称这是车主没有及时接管车辆,与辅助驾驶系统没有关系。而且基本上这些诉讼均已在未开庭审理的情况下得到解决或被驳回。但这次案件却是特斯拉第一次输掉相关诉讼,被认定需要对事故承担部分责任,这也是特斯拉坚持上诉的原因。这次的败诉,就像是为特斯拉打开了一个口子,但马斯克仍然坚称FSD比人类驾驶更安全。前不久,马斯克透露即将发布的FSD
