Apple has said its policy is not to use concealment clauses, but former employees dispute that.</p>\n<p>In September, investor Nia Impact Capital filed a shareholder proposal calling for Apple's board to prepare a \"public report assessing the potential risks to the company associated with its use of concealment clauses in the context of harassment, discrimination and other unlawful acts.\"</p>\n<p>Apple in October filed a response with the SEC saying it wanted to exclude the proposal because \"the company’s policy is to not use such clauses.\"</p>\n<p>In a letter dated Monday, the SEC denied Apple's request, saying that the company had not \"substantially implemented the proposal.\"</p>\n<p>An Apple spokesperson declined to comment on the SEC letter. The company has previously said it does not discuss specific employee matters and is \"deeply committed to creating and maintaining a positive and inclusive workplace.\"</p>\n<p>After viewing Apple's response to the SEC on the shareholder proposal, former Apple employee Cher Scarlett said she filed an SEC whistleblower complaint in October alleging that the company had made false and misleading statements to the regulator. That removes an overhang. And the Build Back Better bill is no longer reflected fully in Tesla and other EV stocks.</p>\n<p>With the new starting point, bulls will be looking at four big catalysts to drive shares higher in coming months.</p>\n<p>For starters, deliveries and earnings always matter. Tesla will report fourth-quarter deliveries in the first couple of days in January. A number around 270,000 will give Tesla about 900,000 deliveries for all of 2021. That should be seen as a good result. If deliveries are strong, the stock should rally into the fourth-quarter earnings report, due about three weeks after delivery results are issued.</p>\n<p><i>Barron’s</i> found Tesla stock has outperformed the S&P 500 seven out of the past nine times in the span between reporting deliveries and reporting quarterly earnings.
